Welcome to Prata Diamonds. These Terms & Conditions apply to your use of the Prata Diamonds website and to enquiries, quotations and purchases made through us.
By using our website or placing an order with us, you agree to these Terms & Conditions.
1. About Prata Diamonds
Prata Diamonds is the trading name of Prata Fine Jewellery (Pty) Ltd, a South African company specialising in custom-made engagement rings, wedding rings and fine jewellery.
Our website provides information about our jewellery, diamonds and services and allows customers to enquire about custom-made pieces.
2. Custom-Made Jewellery
Our jewellery is made specifically according to the requirements agreed with each client.
Before production begins, the final specifications of the piece will be confirmed with the client. These may include:
- Jewellery design
- Metal type and colour
- Diamond or gemstone specifications
- Ring size
- Engraving, where applicable
- Final price
Once production has commenced, changes to the design or specifications may not be possible and may result in additional costs or delays.
Because custom-made jewellery is produced specifically for an individual client, it cannot be cancelled or returned after the order has been confirmed, subject to any rights that cannot legally be excluded under applicable South African law.
3. Enquiries and Quotations
Submitting an enquiry through our website, advertising platforms, WhatsApp or any other communication channel does not constitute an order or a commitment to purchase.
Quotations are based on the specifications discussed with the client and are subject to diamond and material availability and supplier pricing.
Diamond prices and availability can change. A quotation is therefore valid only for the period stated on the quotation.
A quotation does not reserve a particular diamond unless this has been specifically confirmed by Prata Diamonds.
4. Diamond Availability and Certification
Diamonds discussed with or offered to clients are subject to availability.
Where a particular diamond becomes unavailable before an order is confirmed, Prata Diamonds may offer a suitable alternative based on the agreed specifications and budget.
Diamond images and videos are provided for reference. The appearance of a diamond may vary depending on lighting, magnification, photography and display settings.
Where applicable, diamond grading reports or certificates will be supplied with the diamond or jewellery as agreed.
5. Pricing
Prices displayed on our website are subject to change without notice.
The final price of a custom-made piece may depend on factors including:
- Diamond availability and pricing
- Diamond specifications
- Metal type
- Ring size
- Design requirements
- Additional gemstones or features
- Changes requested by the client
The final price will be confirmed with the client before an order is placed.
6. Deposits, Payments, Cancellations and Returns
A 50% non-refundable deposit is required before production of a custom-made jewellery piece can begin.
Once the deposit has been paid and the order has been confirmed, the order cannot be cancelled or returned. This is because custom-made jewellery is produced specifically for the individual client and may involve the procurement of diamonds, gemstones and materials specifically for that order.
The remaining 50% balance is payable in accordance with the payment terms agreed with the client and must be settled before the completed jewellery is released or delivered.
The deposit and any other payments made towards a custom order are non-refundable once the order has been confirmed and production or procurement has commenced, subject to any rights that cannot legally be excluded under applicable South African law.
7. Design Approval
Before production, the client will be given the opportunity to confirm the agreed design and specifications.
The client is responsible for carefully checking the final specifications before approving the order, including:
- Ring size
- Metal type
- Diamond or gemstone specifications
- Design details
- Engraving details, where applicable
- Final price
Once the client has approved the final design and production has commenced, changes may not be possible and may result in additional costs or delays.
Prata Diamonds cannot be held responsible for changes requested after the final design has been approved.
8. Production Times
Estimated production times will be communicated to the client before an order is placed.
Production times are estimates and may vary depending on factors including diamond availability, supplier lead times, design requirements and unforeseen circumstances.
Prata Diamonds will make reasonable efforts to keep the client informed of any significant delays.
9. Images, CAD Designs and Renders
Computer-generated designs, CAD images, renders, photographs and other visual representations are intended to communicate the proposed design.
The final jewellery may have minor visual differences from digital renders, drawings or photographs due to lighting, camera settings, screen displays and the physical characteristics of diamonds and precious metals.
Such minor differences do not necessarily constitute a manufacturing defect.
10. Manufacturing Warranty
All custom-made jewellery purchased from Prata Diamonds is covered by a one-year manufacturing warranty from the date of delivery.
The manufacturing warranty covers defects in manufacturing and workmanship that arise during normal use within the warranty period.
The warranty does not cover:
- Accidental damage
- Misuse or neglect
- Normal wear and tear
- Loss or theft
- Improper care or storage
- Damage caused by impact or excessive force
- Unauthorised repairs, alterations or resizing by another jeweller
- Damage resulting from failure to follow recommended jewellery-care instructions
Diamond or gemstone loss caused by accidental damage, impact or improper care is not considered a manufacturing defect unless determined otherwise by Prata Diamonds following inspection.
If you believe your jewellery has a manufacturing defect, please contact us as soon as possible so that the piece can be inspected and the appropriate remedy can be determined.
Nothing in this warranty excludes or limits any rights you may have under applicable South African consumer law.
11. Jewellery Care
Precious jewellery requires appropriate care to maintain its appearance and condition.
Prata Diamonds recommends following the care instructions provided with your jewellery and having jewellery inspected periodically, particularly where it contains diamonds or other gemstones.
Jewellery should be protected from activities that may expose it to excessive impact, chemicals, heat or other conditions that could cause damage.
Damage caused by misuse, accidental damage, improper care, unauthorised alterations or normal wear and tear may not be covered by the manufacturing warranty.
12. Website Information
We make reasonable efforts to ensure that information on our website is accurate and up to date.
However, occasional errors may occur, including errors relating to descriptions, availability, specifications or pricing.
We reserve the right to correct errors and update information without prior notice.
13. Intellectual Property
All content on this website, including photographs, images, designs, graphics, text, logos, branding and other material, belongs to or is licensed to Prata Diamonds unless otherwise stated.
You may not reproduce, copy, distribute, modify or use our content, designs or branding for commercial purposes without our prior written permission.
Custom jewellery designs created by Prata Diamonds may not be reproduced or supplied to another jeweller for manufacture without our written permission.
14. Third-Party Services
Our website may contain links to third-party websites or use third-party services, including payment providers, social media platforms, messaging services and advertising platforms.
We are not responsible for the content, availability or privacy practices of third-party services.
Your use of those services is subject to their own terms and conditions.
15. Limitation of Liability
To the extent permitted by applicable law, Prata Diamonds will not be liable for indirect or consequential loss arising from the use of our website or services.
Nothing in these Terms & Conditions is intended to exclude or limit any rights or protections that cannot legally be excluded or limited under South African law.
16. Events Outside Our Control
Prata Diamonds will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control.
This may include supplier delays, diamond availability, transport disruptions, natural disasters, strikes, government restrictions, power or network failures or other unforeseen circumstances.
We will make reasonable efforts to minimise the effect of such circumstances and keep affected clients informed.
17. Privacy
Your personal information is handled in accordance with our Privacy Policy.
By submitting an enquiry or providing your personal information to Prata Diamonds, you acknowledge that your information may be collected and processed for purposes associated with your enquiry, quotation, purchase and customer relationship, in accordance with our Privacy Policy and applicable law.
18. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, website, services or legal requirements.
The latest version will be published on this page together with the date on which it was last updated.
19. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any dispute arising from these Terms & Conditions will be subject to the applicable laws and legal processes of South Africa.
